Terms of Service

1. Acceptance of Terms

By creating an account or using CompliPost ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

CompliPost is a web-based platform that helps mortgage loan officers and related professionals create branded, compliance-aware social media content. The Service currently includes AI-powered content generation, graphic design tools, saved templates, export/download workflows, billing, and related account features. Some roadmap items described on the site may be released later and will not be available until specifically launched.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access. You may not share your account with others or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscription and Payment

CompliPost offers a free trial and paid subscription tiers. By subscribing to a paid plan, you agree to pay the fees associated with your selected tier. Subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date. You can cancel your subscription at any time from your account settings. Refunds are handled on a case-by-case basis. We reserve the right to change pricing with 30 days notice to existing subscribers.

5. Usage Limits

Each subscription tier includes limits on the number of posts, image generations, and copy generations per billing cycle. Usage beyond your plan limits will be restricted until the next billing cycle or until you upgrade to a higher tier. We reserve the right to modify usage limits with reasonable notice.

6. AI-Generated Content

CompliPost uses artificial intelligence to generate social media copy and graphics. You acknowledge that:

• AI-generated content is a starting point and should be reviewed before publishing
• You are solely responsible for the accuracy, compliance, and appropriateness of all content you publish, whether AI-generated or manually created
• CompliPost does not guarantee that AI-generated content is free from errors, compliant with all regulations, or suitable for any particular purpose
• AI outputs may occasionally produce unexpected, inaccurate, or inappropriate content
• The compliance review features are tools to assist your review process, not a substitute for professional compliance oversight

7. Mortgage Advertising Compliance

CompliPost provides tools designed to help with mortgage advertising compliance, including disclosure support and content guardrails. However:

• CompliPost is not a law firm, compliance consultancy, or regulatory authority
• Our compliance features do not guarantee regulatory compliance
• You are responsible for ensuring all published content meets applicable federal, state, and local regulations including but not limited to TILA, RESPA, the SAFE Act, the Equal Credit Opportunity Act, Fair Housing Act, and state-specific mortgage advertising rules
• You should consult with your compliance department or legal counsel regarding your specific regulatory obligations
• CompliPost is not liable for any fines, penalties, or legal actions resulting from content you publish

8. Exports and Publishing Responsibility

CompliPost v1 is designed around creating, saving, and exporting content. You are responsible for how and where you publish exported content.

• You are responsible for all content you publish, whether it originated in CompliPost or was edited later
• You must comply with each social media platform's terms of service and community guidelines
• CompliPost is not responsible for actions taken by social media platforms regarding your content or accounts
• If CompliPost later introduces direct publishing or account connections, these Terms may be updated to cover those features

9. Your Content

You retain ownership of all content you create using CompliPost, including generated graphics and copy. By using the Service, you grant CompliPost a limited license to store, process, and display your content as necessary to provide the Service. We do not claim ownership of your content. We will not use your content for marketing or share it publicly without your explicit permission.

10. Brand Kit Information

Information you provide in your brand kit (headshot, logo, NMLS number, contact details) is used solely for generating personalized content. You represent that you have the right to use any images or logos you upload and that your NMLS number and other professional credentials are accurate and current.

11. Prohibited Uses

You may not use CompliPost to:

• Generate misleading, fraudulent, or deceptive mortgage advertising
• Create content that violates fair lending laws or discriminates against protected classes
• Misrepresent your credentials, licensing, or professional standing
• Publish content containing false interest rates, loan terms, or fee information
• Circumvent usage limits through technical means
• Reverse-engineer, scrape, or copy the Service
• Share account access with unauthorized users
• Violate any applicable laws or regulations

12. Intellectual Property

The CompliPost platform, including its design, code, features, and branding, is owned by CompliPost. You may not copy, modify, distribute, or create derivative works based on the Service. The AI models used by the Service are provided by third-party providers under their respective terms.

13. Limitation of Liability

To the maximum extent permitted by law, CompliPost is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes but is not limited to regulatory fines, lost business, reputational damage, or losses resulting from published content. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, compliant, or fit for any particular purpose.

15. Indemnification

You agree to indemnify and hold harmless CompliPost, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your published content, or your violation of these terms.

16. Termination

We may suspend or terminate your account if you violate these terms, engage in prohibited uses, or fail to pay subscription fees. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination to allow for export, after which it will be deleted.

17. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the new terms.

18. Governing Law

These Terms shall be governed by the laws of the State of [Your State], without regard to its conflict of law provisions.
